Petitioner, already in custody, seeks bail in connection with Jamui P.S. Case No.341 of 2017, registered under Sections 147, 148, 149, 307, 153A, 295A and 120B of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that a Tazia procession was being taken by the accused persons and finding the people of other community on the way, it is alleged that Sikandar Khan opened fire causing injury to Banti Sao and another fire was shot by Moti Mian causing injury to the informant and rest others were also armed with pistol.

Learned counsel for the petitioner submits that the petitioner was a member of Tazia procession and there is no

Patna High Court Cr.Misc. No.9197 of 2018(2) dt.16-02-2018 2/2 allegation of opening fire rather that is against two other coaccused Sikandar Khan and Moti Mian and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Nazam Mian @ Nezam Mian is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Jamui P.S. Case No.341 of 2017.
