JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-11-2024 Though the present writ petition has been filed for quashing the proceedings of Encroachment Case No.5 of 202324, however, at the outset, it is submitted by the learned counsel for the petitioners that till the time Jamabandi is existing in favour of the petitioners qua the land in question, the possession of the petitioners over the land in question, cannot be disturbed.

2. Per contra, the learned counsel for the respondent-State submits that such petitioners, in whose favour Jamabandi is existing, shall not be disturbed of their possession over the land in question, till the time Jamabandi is cancelled. It is directed, accordingly.

3. The writ petition stands disposed off on the aforesaid terms.
