JUSTICE MADHURESH PRASAD ORAL ORDER 12-04-2018 Heard counsel for the petitioners, the State and the informant.

Petitioners are accused in a case registered for offence under sections 341, 323, 307, 379, 504/34 IPC. Learned senior counsel for the petitioners submits that other co-accused against whom also there is similar allegations have been allowed bail by this Court vide order dated 19.2.2018, passed in Cr.Misc.No. 8908/2018. He further submits that the injuries do not support the allegations and there is a case and counter case between the parties and the earlier case has been lodged by the petitioners' side bearing Khizersarai Police Station Case No. 297/2017 on the same date. Prior to the lodging of this case, petitioners are accused in two other cases mentioned in paragraph 3 of the bail application, in which they are already on bail. Petitioners are in custody in connection with this case since

Learned counsel for the informant vehemently opposes the prayer for bail.

Considering the aforesaid submissions, prayer for bail of both the petitioners is allowed. Let the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of on the following conditions:- One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
