2. The petitioner apprehends his arrest for the offences alleged under Sections 147, 149, 323, 353, 427, 504 and 506 of the Indian Penal Code, registered in connection with Maranchi (Panchmahala O.P.) P.S.Case No.55 of 2021.

3. As per the allegation, the police after getting information about illegal excavation of soil, reached the place of occurrence. Some of the accused persons, including the petitioner, facilitated in escaping the culprits.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no allegation of illegal

Patna High Court CR. MISC. No.69790 of 2023(2) dt.01-11-2023 2/2 excavation of soil against the petitioner. He has been made accused merely on the basis of criminal antecedent mentioned in paragraph no.3 of the bail petition and in all the cases, he is on bail.

5. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class Barh, Patna in connection with Maranchi (Panchmahala O.P.) P.S.Case No. 55 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
