The petitioner seeks bail in Kalyanpur P.S. Case No. 11 of 2018 registered under Sections 414, 272 and 273 of the Indian Penal Code and Sections 30(a), 38, 38(1), 38(2), 38(3) and 47 of the Bihar Prohibition and Excise Act, 2016. Huge quantity of foreign liquor is said to have been recovered from the poultry farm of the accused Naresh Sahni and the said accused was apprehended. He disclosed the name of the petitioner Chunnu Singh and Mithlesh Sahni as supplier of the said liquor.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the
Patna High Court Cr.Misc. No.20760 of 2018 (2) dt.13-04-2018 2/2 conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the place of occurrence or with Naresh Sahni. He has also no concern with any trade of liquor. He has been falsely implicated in the case by Naresh Sahni due to animosity. He was not apprehended on the spot. He has no criminal antecedent. He has been languishing in custody since 23.02.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge cum Special Judge, Excise Act, Samastipur in connection with Kalyanpur P.S.
