2. The petitioner has preferred this application for grant of regular bail in connection with Bhimpur P.S. Case No. 03/2024 dated 10.01.2024 registered for the offence punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, two unknown miscreants are alleged to have intercepted the motorcycle of the informant and looted Rs. 2,000/-, a mobile phone, PAN Card, Aadhar Card on the point of pistol and fled away with the motorcycle of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.70831 of 2024(2) dt.07-10-2024 2/2 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the course of investigation. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 12.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. As per para. 31 of the case diary, Rs. 2,000/- was recovered from the possession of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul in connection with Bhimpur P.S. Case No. 03/2024.

7. The application stands allowed.
