The petitioners apprehend their arrest in connection with Complaint Case No.769 (C) of 2015 registered under Sections 420, 323and 504 of I.P.C.
Accusation is that the petitioners who are cousin brother and cousin nephew of the complainant, took Rs.2,26,000/- from the father of the complainant and when the complainant demanded his money from the petitioners, they did not return his money. Learned counsel appearing on behalf of the petitioners submits that, in fact, it would appear from the F.I.R. itself that the
Patna High Court Cr.Misc. No.48047 of 2017 (2) dt.11-10-2017 2/2 petitioners used to do work of contract to supply labourers to Agrawal Mills Punjab. He further submits that the petitioners worked for 44 months and 30 months and total wages accrued toRs.7,84,000/- out of which only Rs.3,76,000/- had been paid but remaining amount of Rs.40,800/- has not yet been paid. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be enlarged on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M. Khagaria, in connection with Complaint Case No.769 (C) of 2015 subject to the conditions laid down under Section 438(2) Cr.P.C..
