JUSTICE BIRENDRA KUMAR ORAL ORDER 05-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414,420,467,468,120(B) and 34 of the Indian Penal Code and Section 27(A)(B),28, 28(A) of the Drugs and Cosmetics Act, 1940.
According to FIR, a medical shop was found running without licence. Co-accused-Md. Kutubuddin disclosed to the police that nursing home as well as the medical store is of the petitioner. Hence, the petitioner has been arrayed in this case.
Patna High Court CR. MISC. No.61625 of 2019(3) dt.05-12-2019 2/2 Submission is that the petitioner has got no criminal antecedent nor the searched premise is of the petitioner nor the shop was of the petitioner nor there is any other material to substantiate that the petitioner is proprietor of the said. Considering the aforesaid submission as well as quantum of punishment provided for the alleged offence under the aforesaid Act, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Muffasil P.S.Case No.
166 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
