Petitioner, already in custody, seeks bail in connection with Special Case No.6674 of 2017, arising out of Bakhtiyarpur Rail P.S. Case No.190 of 2017, registered under Sections 147, 148, 149, 323 and 307 of the Indian Penal Code, Section 37(b) of the Bihar Excise Act as well as under Sections 25(1)(b)(a), 26, 35 and 27 of the Arms Act.

It is contended that there is no specific allegation of opening fire against the petitioner and there is no injury to anyone. The petitioner is only said to be found in a drunken condition, the petitioner has no criminal antecedent and he is in custody since 03.10.2017.

No.3554 of 2018(2) dt.31-01-2018 2/2 Having considered the said facts and circumstances, petitioner Gautam Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No.6674 of 2017, arising out of Bakhtiyarpur Rail P.S. Case No.190 of 2017.
