JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Turkauliya (Banjariya) PS Case No. 557 of 2014 registered under Sections 366A, 372 and 506/34 of the IPC.
The allegation in brief is that the accused persons kidnapped minor daughter of the informant, however she escaped from their clutches and returned back.
It is submitted that the girl in her statement under Section 164 Cr.P.C. has named three accused persons Jalil, Makya Babu and Sita and nothing against this petitioner in her statement. Similarly situated accused Chandra Jyoti has been admitted to bail by a coordinate Bench of this Court. The petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Rajeshwar Manjhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran at Motihari in connection with Turkauliya (Banjariya) PS Case No. 557 of 2014.
