JUSTICE BIRENDRA KUMAR ORAL ORDER 12-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Pirbahore P.S. Case No.320 of 2017, a case under Sections 419/420/467/468/120B of the Indian Penal Code and Sections 28/28A/27(d) of Drugs and Cosmetic Amendment Act, 2008. Submission is that there is no allegation that any spurious drug was found from the possession of the petitioner. Only allegation is that the petitioner had sold some medicines without any purchase bill though purchase bill was there in the matter of some of the medicines. The petitioner is in custody since 19.11.2017.

Patna High Court Cr.Misc. No.8247 of 2018 (2) dt.12-02-2018 P2/ Considering the nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
