JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Rasulpur P.S. Case No. 81 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of 3920.76 litres of liquor from a truck and it is alleged that villagers disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that except that there is vague statement that villagers disclosed his name there is nothing against him and even in the case diary statement of the villagers has not been recorded. Heard learned APP, who has opposed the prayer for anticipatory bail but could not controvert the above submission. In view of above facts and circumstances, let

Patna High Court CR. MISC. No.62215 of 2019(3) dt.08-01-2020 2/2 petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-II, Saran at Chapra, in connection with Rasulpur P.S. Case No. 81 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation.
