JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-10-2019 The grievance of the petitioner in the present writ petition is non-payment of difference of salary for the period from 18.12.1980 to December, 2015.

Learned counsel for the petitioner submits that the petitioner has superannuated from the post of HOD, Physics, KSS College, Lakhisarai on 31.12.2015. However, during 18.12.1980 till December, 2015, the respondents have not paid full salary to the petitioner and outstanding arrears are there which have not been paid to the petitioner.

The issue of arrears of difference of salary requires

Patna High Court CWJC No.20675 of 2019(2) dt.16-10-2019 2/2 factual enquiry for which the University is competent authority. Accordingly, the writ petition is disposed of with a direction to the University to verify the record and if any arrears of salary is payable to the petitioner, the University shall calculate the same and ensure payment of difference of arrears of salary at the earliest preferably within a period of three months from the date of receipt/production of a copy of this order.
