1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned counsel for the petitioner submits that the present restoration application has been filed seeking restoration of Cr. Misc. No.7604 of 2017, which stood dismissed for default for non-appearance by an order dated 19.09.2023.

3. The learned counsel for the petitioner submits that the petitioner would be satisfied in the event, if it is observed that petitioner will raise all issues at the time of framing of charge.

4. The learned Additional P. P. does not dispute the

Patna High Court CR. MISC. No.82106 of 2023(2) dt.15-12-2023 2/2 submissions made by the learned counsel for the petitioner, as such, the restoration application is allowed. The Cr. Misc. No.7604 of 2017 is restored to its original file.

5. Since the learned counsel for the petitioner sought permission to withdraw the quashing application with liberty to raise all issues at the time of framing of charge, as such, permission for withdrawal is accorded with the liberty aforesaid.
