1. Heard learned counsel for the parties.

2. The petitioners in this application pray for grant of anticipatory bail apprehending their arrest in connection with Siwan Town P.S. Case no.353 of 2024 registered for the offence punishable under sections 420, 406, 506 and 34 of the Indian Penal Code.

As per allegation in the F.I.R, the informant states that the petitioners introduced him to one Rizvi Ahmad who happens to be the brother of the petitioner no.1 asking the informant to invest in the trading business to earn big profit. The informant states that as a result of the instigation of the petitioners that different amounts were given by the informant at

Patna High Court CR. MISC. No.73456 of 2024(2) dt.12-11-2024 2/3 different times to the said Rizvi Ahmad. A total sum of Rs.36.5 lakhs was given out of which Rs. 9.46 lakhs was transformed online. The informant states that he has not received any profit till date.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. From reading of the FIR itself it would transpire that transaction of money, if any, has been between the informant and Rizvi Ahmad and the informant is dissatisfied with not having been earned profit. The reason for implication of these petitioners is that the informant was introduced by him to the said Rizvi Ahmad who happens to be the full brother of the petitioner no.1. It is further stated that there is no allegation so far as these petitioners are concerned. With respect to the earlier cases it is stated that in one of the cases the petitioners have been enlarged on bail and in the other case final form has been submitted. The petitioners undertake to cooperate in the investigation/trial.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the main allegation being against Rizvi Ahmad and not the petitioners

No.73456 of 2024(2) dt.12-11-2024 3/3 herein, it is directed that the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Siwan Town P.S. Case no.353 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Siwan.
