The petitioner, who is in custody, seeks bail in connection with Kurtha P.S. Case No. 189 of 2017 registered for the offence punishable under Sections 379, 411 and 34 of the Indian Penal Code.

Informant is the Manager of Inden Service, who in his written report has stated that when he had gone for depositing money in S.B.I, Branch and as he came out after depositing money , in the meantime a person tried to flee away carrying his black colour bag. On alarm the local people assembled there and catch hold him. He has further stated that from the bag Rs. 1000/- were recovered and the person

Patna High Court Cr.Misc. No.16787 of 2018(3) dt.13-04-2018 2/2 concerned has disclosed his name to be Kabadi Rajesh Kumar. The local people has also recovered a 'T' type instrument from his possession.

Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. It has been further submitted that local people have catch hold the petitioner on mere suspicion as he does work of collection of Kabad in the locality and looks like a rustic person. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 21.11.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Arwal (Jehanabad), in connection with Kurtha P.S. Case No. 189 of 2017.
