JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nauhatta P.S. Case No. 133 of 2022 registered for the offences punishable under Sections 406, 409, 420/34 of the Indian Penal Code .

As per the prosecution case, the petitioner defalcated government money which was allotted for completion of work of soil filling in the Gram Panchayat "Raj Hati" under the scheme of Mukhya Mantri Saat Nischay Yojna. Learned counsel for the petitioner submitted that petitioner has no concern with the alleged work. He has not received any fund for the said scheme. As a matter of fact B.D.O Nauhatta had only authorized him to inquire into the matter and

Patna High Court CR. MISC. No.69804 of 2022(2) dt.04-04-2023 2/2 submit a report for the aforesaid period. Only on account of suspicion petitioner has been implicated in this case. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate, 1st class Saharsa in Nauhatta P.S. Case No. 133 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
