2. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 139, 96, 64 and 61 of the BNS, Section 8 of the POCSO Act and Sections 3(1)(r) and 3(1)(s) of the SC/ST Act.

3. As per F.I.R., on the alleged date and time of occurrence, all the accused persons including the petitioners came at the house of the informant and offered to solemnize

No.67950 of 2025(2) dt.24-09-2025 2/3 marriage of the victim girl with the son of the petitioner no.1, Raja Kumar which was refused by the brother of the informant as the girl is minor. It is further alleged that accused persons enticed away the minor daughter of the informant and on assurance of marriage committed rape with her.

4. It is submitted on behalf of the petitioners that the petitioners are innocent and and have committed no offence as alleged. Specific accusation of sexual abuse on pretext of marriage is against co-accused Raja Kumar. Petitioner nos.1 and 2 are parents, petitioner nos.3 is brother and petitioner no.4 is uncle of the co-accused Raja Kumar. The petitioners have been made accused in this case because they are family members of the co-accused Raja Kumar. As a matter of fact, the victim girl was in relationship with co-accused Raja Kumar who subsequently refused to carry on the relationship. Petitioners have got no concern with the alleged occurrence. The Petitioners claim clean antecedent.

5. Learned counsel for the informant opposes the bail petition and submits that the petitioners are named in the FIR and they have also participated in the alleged occurrence. Hence, they do not deserve the privilege of anticipatory bail.

No.67950 of 2025(2) dt.24-09-2025 3/3 petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 7th District and Additional Sessions Judge-cum-Special Judge POCSO Act, East Champaran, Motihari in connection with SC/ST P.S. Case No. 24 of 2025, subject to the conditions laid down under section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS), 2023.
