2. Petitioners seek regular bail in connection with Udwantnagar P.S. Case No. 149 of 2025 dated 23.03.2025 registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The main submissions advanced by the petitioners' counsel are that this is the second attempt of the petitioners to get the relief of bail and their first attempt for the same relief was rejected by this Bench vide order dated 18.07.2025, passed in Cr. Misc. No. 43634 of 2025 and the fresh grounds taken by

No.67606 of 2025(2) dt.19-09-2025 2/3 the petitioners for renewing their prayer are their present custody period, the stage of their trial, and the liberty granted to them by this Court while rejecting the earlier prayer. It is further submitted that the trial of the petitioners has started and charges have been framed against them on 01.08.2025. It is lastly submitted that the material witnesses of the prosecution, who are to be examined in the trial of the petitioners, are government officials, therefore, the release of the petitioners on bail will not affect the prosecution in any manner.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioners.

5. Heard both sides. Though there is serious allegation against the petitioners, however, considering the fact that the trial of the petitioners has started and charges have been framed against them and the material witnesses who are to be examined in the trial of the petitioners are government officials, so, the release of the petitioners on bail at this stage will not affect the prosecution in any manner, in my opinion, in the said circumstances, the petitioners now deserve the relief of bail. Accordingly, let the petitioners named-above be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the
