JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 15.12.2017, seeks bail in connection with Danapur P.S.Case No. 631 of 2017 registered under Sections 406, 420, 467, 468, 471 and 120B/34 of the Indian penal Code.
Allegation in brief is that one Swarn Jayanti Sewa Samiti, a Non Governmental Organization advertised some posts for appointment. It is alleged that money was taken for appointment with assurance to give Rs. 18,000/- per months salary and LIC police of Rs. 7,50,000/- each, but they were engaged only for one year approximately and salary was given to the tune of Rs. 5000 to 10,000/-. Later on, Organization office was closed, no salary was given to the informant. A cheque was issued of Rs. 60,000/- by Omkar Nath, Secretary of the Organization but he taken back by
Patna High Court Cr.Misc. No.18527 of 2018 (2) dt.03-04-2018 2/2 some pretext.
Submission is that petitioner is not named in the FIR, there is specific allegation against the Secretary, Chairman and C.A.O. of the concerned N.G.O. Petitioner was a desk employee in the Organization on the salary basis and it was not in his knowledge that they have cheated the petitioner along with other employees like the informant engaged by the Organization and no transaction of money has been done by the petitioner.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Gunjesh Singh @ Gunjesh Kumar @ Gunesh Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Danapur, Patna, in connection with Danapur P.S.
