JUSTICE ARUN KUMAR ORAL ORDER 22-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Baikunthpur PS Case No. 45 of 2017 registered under Section 395 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act. Submission is that the FIR is against unknown, only material which transpired during investigation against the petitioner is disclosure of his name by two co-accused in their respective confessional statements and except that there is no other material, there is no recovery from the possession of the petitioner nor he was put on TIP, though he has criminal antecedents but he has been in custody for approximately one year.

Having considered the said facts and circumstances, the petitioner, namely, Badri Mahato is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Neeraj Kumar Pandey, Judicial Magistrate, lst Class, Gopalganj in connection with Baikunthpur PS Case No. 45 of 2017. The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
