JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 8.9.2017, seeks bail in Bachhwara PS Case No. 128 of 2017 registered under Sections 25(1b)a and 26 of the Arms Act. The allegation in brief is that during vehicle checking a country made pistol along with five live cartridges were recovered from the possession of the petitioner.

It is submitted that the petitioner has falsely been implicated, he has no criminal antecedent except one complaint case registered in the year 1996, he is in custody since 8.9.2017 and witnesses of the seizure list are two police personnel out of the police party. Having considered the said facts and circumstances, the petitioner, namely, Surendra Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Begusarai in connection with Bachhwara PS Case No. 128 of 2017.
