JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-03-2021 The learned counsel for the petitioner seeks to withdraw the present writ petition, however, seeks liberty to approach the Appellate Authority by filing appropriate appeal against the order dated 09.08.2017 passed by the District Programme Officer, Lakhisarai.

Accordingly, the present writ petition stands dismissed as not pressed, however, with

Patna High Court CWJC No.15173 of 2017(3) dt.03-03-2021 2/2 liberty to the petitioner to file appropriate appeal before the Appropriate Authority against the aforesaid order dated 09.08.2017 passed by the District Programme Officer, Lakhisarai, in case such an appeal has not been filed earlier.

It is needless to state that in case, an appeal, as aforesaid, is filed within a period of four weeks from today, the same shall be considered and disposed of on merits in accordance with law, without the Appellate Authority being impeded by the issue of limitation.
