====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-12-2019 Heard learned counsel for the petitioner, the learned counsel for the informant and learned Additional Public Prosecutor for the state.
The petitioner seeks bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 254 of 2019, registered under Sections 307, 385, 387 and 34 of the Indian Penal Code and 27 of the Arms Act.
The accusation is that on 22.03.2019 at about 02.00 p.m., informant, Dharmendra Kumar, heard the sound of fire from the roof of his house, then, he got down from the roof and saw that his brother, Shailendra Kumar @ Manoj, has sustained fire arm injury. On query, he disclosed that Sudhir Sao, Robin Kumar (petitioner), Manoj Kumar and Arvind Kumar were present near the high school, Sudhir Sao and Robin Kumar took

At that time, Sudhir Sao told that why the ransom was not paid and Chandan Kumar was also with him present with Sudhir Sao. Learned counsel appearing on behalf of the petitioner submits that while allegation has been made in the first information report to shot fire to Shailendra Kumar, brother of the informant by Sudhir Sao and only one injury was found on the chest of the brother of the informant, which is grievous in nature.
Having regard to the facts and circumstances of the case, I am inclined to grant bail to the petitioner. The prayer for bail is rejected. The petitioner may renew his prayer for bail after six months.
