JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Chenari P.S. Case No.15 of 2017, a case under Sections 363/366A/34 of the Indian Penal Code, pending in the Court of Additional Sessions Judge-I-cum-Special Court POCSO, Rohtas at Sasaram.

The FIR was lodged with allegation that the petitioner kidnapped to the daughter of the informant. The victim on recovery alleged kidnapping against the petitioner and one Vikky Tiwari as well as attempt by the petitioner to sell her. Learned counsel for the petitioner submits that the petitioner is in custody since 04.04.2017. He is ready to cooperate

Patna High Court Cr.Misc. No.9110 of 2018 (3) dt.27-03-2018 P2/ with the trial.

No material has been produced to substantiate any intimacy between the petitioner and the victim girl. Hence, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial.
