In this case, the petitioner is seeking regular bail in connection with Excise Case No. 519 of 2022 arising out of Barbigha (Mission O.P.) P.S. Case No. 419 of 2022 registered for the offences under Sections 30(a)/32 (ii)/ 41(i) of the Bihar Prohibition and Excise Amendment Act.

Considering the nature of allegations leveled against the petitioner and also the fact that he has no criminal antecedent, and in-as-much as petitioner is in custody since 28.09.2022. Accordingly, this bail application is allowed. Let the petitioner, above-named, be released on bail after framing of charge on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount

No.74088 of 2022(2) dt.04-03-2023 2/2 each to the satisfaction of learned A.D.J-2nd, Sheikhpura in connection with Excise Case No. 519 of 2022 arising out of Barbigha (Mission O.P.) P.S. Case No. 419 of 2022, subject to the condition that the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.

It is clarified that if the charge has already been framed in the case, the bail bond of the petitioner shall be accepted by the court below.

The petitioner will visit Mohanpur Police Station, District- Gaya on the first Sunday of each month. Any Default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
