The petitioner seeks bail in Bakhari P.S. Case No. 47 of 2012 registered for the offence punishable under Sections 420, 467, 468 and 409 of the Indian Penal Code. Accusation is of misappropriating the fund under MANREGA and BRGF scheme in the year 2009-10 and 201011. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case on mere suspicion. The only fault of the petitioner is that being the Panchayat Secretary, he has signed the cheque with Mukhiya, who has already been granted bail. It has further been submitted

No.14822 of 2018(3) dt.10-04-2018 2/2 that similarly situated co-accused persons namely, Mukhiya Junior Engineer and Assistant Engineer have been granted bail by a co-ordinate bench of this Court vide orders dated 24.10.2013 in Criminal Miscellaneous No. 44725 of 2012, dated 31.01.2013 in Criminal Miscellaneous No. 46552 of 2012 and dated 07.02.2013 in Criminal Miscellaneous No. 48935 of 2012. Petitioner is in custody since 02.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bakhari P.S. Case No. 47 of 2012.
