JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-10-2024 The present petition has been filed for restoration of a writ petition bearing CWJC No. 4418 of 2022, which has stood dismissed for default on account of noncompliance of the peremptory order dated 19.12.2022, passed by this Court.

The learned counsel for the petitioner submits that on account of certain unavoidable difficulties, some time has been consumed in removing the defects pointed out by the Registry, however, now all the

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing CWJC No. 4418 of 2022 to its original file, however, subject to the Registry verifying the fact as to whether all the defects have stood removed or not.

The present petition stands disposed of on the aforesaid terms.
