JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2019 This application, for grant of anticipatory bail, arises out of Barauni (Chakia O.P.) P.S. Case No. 277/2019, disclosing offences under Sections 341, 323, 379, 307, 506/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant by means of khanti causing injuries to him. Submission of learned counsel for the petitioner is that he is brother of the informant and he has falsely been implicated in this case due to family dispute and although two injuries have been sustained by the informant but that is not on the vital part of the body as one on injury has been caused on shoulder and another on hand.

Patna High Court CR. MISC. No.66494 of 2019(3) dt.17-12-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Chakia O.P.) P.S. Case No. 277/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
