2. The petitioner seeks bail in connection with Katihar P.S. Case No. 301 of 2023 registered for the offence under Sections 399 and 402 of the Indian Penal Code as well as under Section 25(1-B)A, 26/34 of the of the Arms Act.

3. As per the prosecution case, while planning the loot, petitioner and others were arrested and some incriminating materials has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits petitioner is innocent and has falsely been implicated in this case. Petitioner is in custody since 24.04.2023.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.71305 of 2023(2) dt.07-11-2023 2/2 prayer for bail.

6. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar/concerned Court below in connection with Katihar (N) P.S. Case No. 301 of 2023.

8. The petitioner will mark his attendance at the Mansahi Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
