JUSTICE SANDEEP KUMAR ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Piprakothi P.S.Case No. 75 of 2023 for the offence punishable under Section 392 of the Indian Penal Code.

It is alleged that some unknown miscreants looted cash Rs. 2,80,000/- from the informant and fled away. Learned cousnel for the petitioner submits that petitioner is not named in the FIR and on the basis of confessional statement of co-accused, his name has been surfaced in this case. He is in custody since 08.06.2023. Learned cousnel for the petitioner submits that petitioner has got three another criminal antecedents in which he is on bail. Learned APP has vehemently opposed the prayer of

Patna High Court CR. MISC. No.69503 of 2023(2) dt.01-11-2023 2/2 bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Piprakothi P.S. Case No. 75 of 2023.

The petitioner will visit Piprakothi police station on the first and third Sunday of each month. Any default in appearance at the police station would be result in cancellation of bail bond of the petitioner.
