JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-09-2019 The learned counsel for the Patna Municipal Corporation submits that earlier a counter affidavit has been filed wherein it has been stated that except the amount of provident fund, the entire retiral benefits of the petitioner has stood paid. Today, the learned counsel for the Patna Municipal Corporation has produced a letter dated 3.8.2019 whereby and whereunder the provident fund amount of the petitioner along with the statutory interest has been directed to be paid to the petitioner and the said amount has also been paid as is apparent from the communication of the Executive Officer, Patna Municipal Corporation dated 3.8.2019.

Patna High Court CWJC No.14604 of 2017(3) dt.04-09-2019 2/2 Having regard to the submissions made by the learned counsel for the respondents to the effect that the entire death cum retiral dues has already stood paid to the petitioner herein, I deem it fit and proper to dispose of the present writ petition, however, with liberty to the petitioner to file appropriate interlocutory application in the present writ petition in case, any part of the retiral dues are still remaining to be paid. The writ petition stands disposed of on the aforesaid terms.
