The petitioners seek bail in connection with Barachatti P.S. Case no. 100 of 2018 registered under Sections 30(a), 30(d), 30(g), 38 and 47 of Bihar Prohibition & Excise Act-2016.
40 lts. of country made liquor is said to have been recovered from Tata Indigo car and petitioner no. 1 (Vijay Kumar Singh) who happens to be its driver and Petitioner no. 2 (Ramesh Singh) its commuter were apprehended. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from conscious physical possession of the petitioners. They have no concern
Patna High Court Cr.Misc. No.19445 of 2018(2) dt.27-04-2018 2/2 with the seized liquor. They have no knowledge of keeping the said liquor in the vehicle in question by its owner. They have been falsely implicated in the case by the police at the instance of their enemies. They have no criminal antecedent. They have been languishing in custody since 07.02.2018. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Barachatti P.S. Case no. 100 of 2018.
