JUSTICE ARUN KUMAR ORAL ORDER 19-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 7.2.2018, seeks bail in Kutumba PS Case No. 180 of 2017 registered under Sections 341, 436, 427, 379, 386, 387/34 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that three FIR named accused persons alighted the students from the school bus and set the vehicle on fire.
Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, there is no allegation against him of setting fire of the school bus, only material which transpired against the petitioner is disclosure of his name by one Raj Kumar Mehta that he was watching police movement in order to alarm other accused persons.
Having considered the said facts and circumstances especially as there is no allegation of setting he vehicle on fire by the petitioner so the petitioner, namely, Dharmendra Mehta is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Kutumba PS Case No. 180 of 2017.
