01-02-2018 Heard learned counsel for the petitioner. None appeared on behalf of the State.
Petitioner, in the present case, is seeking regular bail in connection with Bahadurpur P.S. Case No. 45 of 2017 registered for the offence punishable under Sections 400, 401, 413, 414, 420, 467 and 468 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner in the present case has been falsely implicated at the instance of the co-accused who made confessional statement. Later on police extracted extra judicial confessional statement from this petitioner as well but nothing has been recovered from his possession. Learned counsel for the petitioner further
Patna High Court Cr.Misc. No.4588 of 2018 (2) dt.01-02-2018 submits that this petitioner is in jail since 16.02.2017. It is also stated that the petitioner has one case on his head, as stated in paragraph 3, however, in the said case, he is not on bail.
Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail, if not wanted in any other case, on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Darbhanga, in connection with Bahadurpur P.S.
