The petitioner, who is in custody, seeks bail in connection with Kotwali (Adampur) P.S. Case No. 733 of 2017 registered for the offence punishable under Sections 364 and 302 (added) of the Indian Penal Code.
Informant is the wife of deceased advocate who in her written report has stated that on 10.10.2017 her husband went to the court but did not return back till 5:00 PM then she tried to contact on his mobile but it was switched off and thereafter she informed to her family members and Secretary of District Bar Association. She along with her family made search but could not be traced. It has been further stated that her
Patna High Court Cr.Misc. No.15775 of 2018(3) dt.12-04-2018 2/2 husband has initiated mission against land Mafia people and is an R.T.I. worker and also there was land dispute relating to Kabragah. The informant believes that unknown persons have kindnapped her husband with intent to kill him. Learned counsel for the petitioner submitted that petitioner is not named in the FIR. It has been further submitted that he is innocent and has been falsely implicated in this case. The petitioner has been arrested on the basis of C.D.R. and save and except there is nothing against the petitioner. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 18.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Kotwali (Adampur) P.S. Case No. 733 of 2017.
