2. The petitioner has prayed for bail in connection with Harsidhi P.S. Case No. 588 of 2023 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
3. The case of the prosecution is that police had information that certain persons have gathered for committing some offence. Two accused persons, namely, Irshad Alam and Sandeep Kumar were apprehended.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this
Patna High Court CR. MISC. No.68274 of 2025(2) dt.24-09-2025 2/2 case. It has been submitted that the name of this petitioner has surfaced on the statement of co-accused Sandeep Kumar. It has also been submitted that co-accused Sandeep Kumar has been granted bail by learned Co-ordinate Bench vide order dated 17.02.2024 passed in Cr. Misc. No. 7986 of 2024. It has also been submitted that the case of this petitioner stands on better footing than that of Sandeep Kumar. Petitioner is languishing in judicial custody since 18.06.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Harsidhi P.S. Case No. 588 of 2023.
