1. Heard learned counsel for the petitioner and learned APP for the State.

2. On query of the Court with regard to the stage of the case, the learned counsel for the petitioner submits that the stage has changed, charges have been framed.

3. The learned APP for the State thus opposes the quashing application and submits that since charges have been framed, it signifies commencement of the trial and once the trial has commenced, the Court should be reluctant in interfering with the order impugned.

4. Considering the submission made by the learned APP for the State and the fact that charges have been framed

Patna High Court CR. MISC. No.48497 of 2017(2) dt.23-11-2023 2/2 and trial has commenced, as such, the Court is not inclined to entertain the quashing application.

5. Accordingly, the present quashing application stands rejected.
