The petitioner seeks bail in Panjwara P.S. Case No. 04 of 2016 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.
Allegation against the petitioner is of committing dacoity.
It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely implicated in this case on mere suspicion due to village politics. It has been further submitted that the petitioner is not named in the FIR and nothing has been recovered from the possession of the petitioner. Similarly situated co-accused persons have been granted bail by a co-ordinate bench of this court vide order
Patna High Court Cr.Misc. No.16461 of 2018(3) dt.13-04-2018 2/2 07.07.2017 in Criminal Miscellaneous No. 26455 of 2017, order dated 22.08.2017 in Criminal Miscellaneous No.27986 of 2017, dated 05.02.2018 in Criminal Miscellaneous No. 6392 of 2018. Petitioner has got no criminal antecedent and is in custody since 29.12.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Panjwara P.S. Case No. 04 of 2016.
