JUSTICE PURNENDU SINGH ORAL ORDER 03-04-2024 Heard Mr. Kishore Kumar Thakur, learned counsel appearing on behalf of the petitioner and Mr. Sunil Kumar Mandal (SC 3) along with Mr. Bipin Kuma (AC to SC 3), learned counsels for the State.

2. Learned counsel appearing on behalf of the petitioner informs that the order dated 20.07.2023 passed in CWJC No.19840 of 2021 has not been complied with in its true spirit, however, the representation of the petitioner has been disposed of on 07.12.2023 as contained in Memo No.6759 dated 09.12.2023 denying the relief(s) as claimed by the petitioner on the ground that the petitioner has filed SLP before the Apex Court and the same is pending. The petitioner seeks to avail the appropriate remedy before the appropriate forum.

3. Under the above mentioned circumstances and the fact that the representation of the petitioner has been disposed of by a reasoned order, I do not find to proceed to initiate a contempt proceeding against the concerned respondents/opposite parties.

4. The petitioner, if so advised, may seek appropriate remedy before the appropriate forum against the order dated 07.12.2023 contained in Memo No.6759 dated 09.12.2023.
