Petitioner, already in custody, seeks bail in connection with Mansahi P.S. Case No.53 of 2016, giving rise to S.T. No.277 of 2016, registered under Sections 302, 201, 34 of the Indian Penal Code.
The petitioner's prayer of bail was rejected twice by order dated 01.03.2017, passed in Cr. Misc. No.52080 of 2016 and order dated 01.11.2017, passed in Cr. Misc. No.51597 of 2017. On 01.11.2017, the prayer of bail of the petitioner was rejected with an observation that petitioner may renew his prayer of bail, if the trial is not concluded within four months. Learned counsel for the petitioner submits that even after four months of expiry from the date of the report of the Sessions
Patna High Court Cr.Misc. No.7464 of 2018(2) dt.21-02-2018 2/2 Judge, trial has not concluded and similarly situated other coaccused person Dilip Sahni was admitted to bail by a coordinate Bench of this Court by order dated 25.01.2017, passed in Cr. Misc. No.51935 of 2016.
Having considered the said facts, petitioner Ravi Sahni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with Mansahi P.S. Case No.53 of 2016, giving rise to Sessions Trial No.277 of 2016 with condition that the petitioner shall remain present before the trial court on each and every date and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
