Petitioner, already in custody, seeks bail in connection with Sherghatti P.S. Case No.234 of 2017 (G.R. No.843 of 2017), registered under Sections 385, 387 of the Indian Penal Code as well as under Section 17 of the C.L.A. Act.

Allegation in brief is that bearer of Mobile No.7546004415 and 7261841847 and the petitioner used to make demand of extortion from the informant.

Learned counsel for the petitioner seeks bail of the petitioner on the ground of parity as one of the co-accused, Sudhir Kumar, who is alleged to have made the demand from his mobile, has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.46817 of 2017 on 07.11.2017 and

Patna High Court Cr.Misc. No.16168 of 2018(2) dt.26-03-2018 2/2 the petitioner is in custody since 09.05.2017. Having considered the aforesaid facts and circumstances, petitioner Akhilesh Das is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghatti, Gaya in connection with Sherghatti P.S. Case No.234 of 2017 (G.R. No.843 of 2017) with conditions that one of the bailors must be the close family member of the petitioner and the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
