2. The petitioners apprehend arrest in connection with Bakhtiyarpur P.S. Case No. 307 of 2025 dated 27.06.2025, registered for the offence punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that the accused persons named in the F.I.R. along with 8 to 10 unknown persons attacked the informant due to which he sustained injury on head and hand. It is further alleged that Purushotam Kumar fired
Patna High Court CR. MISC. No.69070 of 2025(2) dt.24-09-2025 2/3 from country-made pistol which missed. Further, it is alleged that Uttam Kumar assaulted the informant with farsa due to which his finger got cut. It is also alleged that they snatched Rs. 25,000/- cash & gold chain.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that there is case and counter case between the parties and the present case is counter blast of Salimpur P.S. Case No. 176 of 2025. It is submitted that there is specific allegation against petitioner no. 3 that he assaulted with farsa on the little finger of left hand of the informant due to which his finger got cut. The injury report reveals that the injury is caused by hard and blunt object. There is no mention about sharp cut weapon in the injury report. So far injury on the head of the informant is concerned, all the accused persons are said to have assaulted on the head. There is no specific allegation against the petitioner. Lastly, it has been submitted that there is one criminal case against petitioner nos. 2 & 3 and petitioner no. 1 has three criminal cases against him.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of
Patna High Court CR. MISC. No.69070 of 2025(2) dt.24-09-2025 3/3 the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Bakhtiyarpur P.S. Case No. 307 of 2025, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Barh, Dist.-Patna, subject to condition as laid down Section 482(2) of B.N.S.S..
