KUMAR ORAL ORDER 05-03-2018 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners, who are in custody, seek bail in connection with Sasaram (M) P.S. Case No. 879 of 2017 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of Arms Act. Informant is the nephew of deceased, who, in his fardbeyan has stated that the deceased (uncle of the informant) Baban Pal after grazing the cattle in the night went in the field of Jhulan Sah to sleep and thereafter the informant went outside to attend the call of nature he saw five accused as named in the FIR variously armed went to the field of Jhulan Sah and shot dead his uncle while he was

It has been submitted that there is no specific allegation against the petitioners of firing on the deceased and there is general and omnibus allegation against all. It has further been submitted that petitioners have no criminal antecedents and they are in custody since 25.06.2017. Learned counsel for the informant has opposed the prayer for regular bail to the petitioners.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (M) P.S.
