JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending arrest in connection with Complaint Case No. 1504(c) of 2003 for an offence under sections 406 and 420 of the Indian Penal Code.

From perusal of the complaint, it appears that dispute pertains to non-payment of outstanding dues from 20012002. It appears that such money claim is not even maintainable by way of filing money suit as it is barred by limitation and the respondent- informant has filed this case for realizing the outstanding dues.

Considering the peculiar facts and circumstances as stated above, the petitioner, named above, is directed to be released on bail in the event of arrest or surrender before the court

Patna High Court Cr.Misc. No.49528 of 2017 (2) dt.18-10-2017 2/2 below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Complaint Case No. 1504(c) of 2003, subject to the condition as laid down under section 438(2) of the Cr.P.C.
