The petitioner seeks pre-arrest bail in connection with Barsoi P.S. Case No. 152 of 2019 registered under Sections 420 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

On receiving secret information about selling toddy (tari) inside the project school of Barsoi, the informant, along with other police officials, reached there. On seeing the vehicle of police, one person succeeded to flee away. On search, six bottles, each containing one liter tari, recovered from there. Submission is that the petitioner is not named in the first information report. In course of investigation it has come in paragraph 12 of the case diary that the person who was fleeing away from the place of occurrence was the petitioner.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Barsoi P.S. Case No. 152 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge II-cum- Special Judge, Excise Act, Katihar, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
