2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 354(A), 379, 504 and 34 of the Indian Penal Code.

3. As per F.I.R., on 16.03.2019 at about 08:30 A.M., the wife of the informant was at her tubewell. In the meantime, two persons armed with weapons came and started abusing her. It is alleged that Bechan Mandal assaulted on the head of the wife of the informant by axe and the petitioner no.1 tried to outrage her modesty and petitioner no.2 snatched silver chain.

4. It is submitted on behalf of the petitioners that petitioners are innocent and have committed no offence.

Patna High Court CR. MISC. No.67448 of 2025(2) dt.23-09-2025 2/2 Specific accusation of assault is against Bechan Mandal and there is no specific allegation of overt act against these petitioners. Petitioners are neighbors and due to petty dispute, this false and concocted case has been lodged. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the bail petition.

6. Considering the clean antecedent of these petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. III, Madhepura in connection with Kumarkhand P.S. Case No. 51 of 2019, subject to the conditions laid down under section 438(2) of the Cr.P.C.
