The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown. The petitioner is in custody since 03.12.2016. Submission is that the petitioner was never put on Test Identification Parade nor any incriminating thing was recovered from his possession. Only material is confessional statement of the petitioner and his criminal antecedent. Considering the nature of allegation and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)
Patna High Court Cr.Misc. No.20551 of 2018 (2) dt.16-04-2018 P2/ with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ahiyapur P.S. Case No.736 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
