JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399/402/414 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act. The police suspected that the assembled persons were planning to commit dacoity, three persons apprehended and two fled away. The petitioner was not apprehended at the spot.

Submission is that co-accused Rahul Yadav was arrested at the spot who has already been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No.50680 of 2017 considering his period of detention as well as criminal antecedent and the fact that nothing incriminating was recovered from his possession.

Patna High Court Cr.Misc. No.15909 of 2018 (2) dt.21-03-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Town Police Station Case No.240 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
