Petitioner, already in custody, seeks bail in connection with Belhar PS Case No.50 of 2017, registered under Sections 341, 323, 324 and 307 of the Indian Penal Code. Allegation in brief is that the petitioner assaulted the victim by sword.

Submission is that the petitioner is the neighbour of the informant and there was no repetition of blow and he is in custody for last one year; whereas learned counsel for the State submits that three sharp cut injuries were found on the person of the injured, so there was repeated blow and trial is proceeding in this case.

Having considered the specific allegation against the

Patna High Court Cr.Misc. No.23174 of 2018(2) dt.19-04-2018 2/2 petitioner of giving sword blow on the vital part of the body, so the prayer of bail of the petitioner is rejected in connection with Belhar PS Case No.50 of 2017, giving rise to Sessions Trial No.382 of 2017.

However, the trial court is directed to expedite the trial on day to day basis and preferably conclude the same within six months.
